Governor Hochul Vetos Notary Bill

The notary requirements around strict recording and retention of transaction records will remain in effect after Governor Kathy Hochul vetoed bill No. A07241A/S8663 on November 22, 2024.

Bill No. A07241A/S8663, initially introduced in May 2023, attempted to streamline the administrative responsibilities of public notaries in New York by exempting non-electronic notary acts from the previously established recording and storage requirements.

The bill was introduced as a response to the Executive Order § 135-c, enacted in 2022, to establish procedures for electronic notary. Many groups, including the New York State Bar Association, called on Governor Hochul to remove the onerous requirements which have caused a 10% decrease in active notaries in NYS. After the veto, the bill was tabled, and the requirements will remain in effect for the foreseeable future.
